Current USPTO averages
The USPTO publishes current averages for the first examining action and for disposal of applications. These measures describe different stages and are not a promised registration date. Check the current figures when planning, then account for the filing basis and issues specific to your application.
What can extend the process
- An Office Action requiring a response.
- A suspension while another application or issue is resolved.
- An opposition after publication.
- An intent-to-use application that is not yet ready for a Statement of Use.
- Incomplete information, additional fees, or changes to the application.
What happens after filing
The application receives a serial number, enters examination, and is reviewed by a USPTO examining attorney. If approved, it is published for opposition. A use-based application may then proceed toward registration. An intent-to-use application generally must complete the required use filing first.
